Terms of Service

1. Acceptance of Terms
By creating an account or using KiwiTrack ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and KiwiTrack.
2. Description of Service
KiwiTrack is a work-hour tracking application that helps users in New Zealand log shifts, estimate gross pay (including Holiday Pay and PAYE tax), and manage employment records. The pay and tax calculations are estimates only and do not constitute financial, tax, or legal advice. Always consult a qualified accountant or the Inland Revenue Department (IRD) for official figures.
3. Accounts and Eligibility
- You must be at least 16 years old to use KiwiTrack.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information when creating your account.
- One person may not maintain more than one active account for the purpose of extending free trial access.
4. Free Trial
New accounts receive a 7-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial, access to the app will be restricted until a subscription is activated. The free trial is intended for genuine first-time evaluation of the Service. Creating multiple accounts to repeatedly access the free trial is a violation of these Terms and may result in account termination.
5. Subscriptions and Billing
Plans available:
- Monthly Plan: NZD $7.96 billed monthly (equivalent to $1.99/week).
- Annual Plan: NZD $51.48 billed annually (equivalent to $0.99/week).
All prices are in New Zealand Dollars (NZD) and include applicable taxes. Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis until you cancel.
Cancellation:You may cancel your subscription at any time through the "Manage Subscription" option in your profile. Cancellation takes effect at the end of the current billing period — you retain access until then. No partial refunds are issued for unused time within a billing period.
Failed payments:If a payment fails, your subscription will enter a "past due" state and access may be restricted. We will attempt to retry the charge.
6. Refund Policy
We offer a full refund within 7 days of the first payment if you are not satisfied with the Service. To request a refund, contact support@kiwitrack.app with your account email and reason. Refund requests after 7 days of the first payment will be assessed on a case-by-case basis.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorised access to other users' data.
- Reverse-engineer, scrape, or probe the Service for vulnerabilities.
- Upload malicious content or attempt to disrupt the Service.
- Share your account credentials with other individuals.
8. Data and Privacy
Your use of KiwiTrack is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You own your data. We do not claim any rights to the shift records, employer information, or pay data you enter into the Service.
9. Disclaimer of Warranties
KiwiTrack is provided "as is" without warranties of any kind. We do not warrant that the Service will be error-free, uninterrupted, or that pay/tax calculations will be accurate for your specific circumstances. Tax laws change — always verify figures with the IRD or a registered tax agent.
10. Limitation of Liability
To the maximum extent permitted by New Zealand law, KiwiTrack shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost wages, tax penalties, or visa issues. Our total liability to you for any claim shall not exceed the amount you paid to KiwiTrack in the 3 months prior to the claim.
11. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the free trial system. You may delete your account at any time by contacting support. Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
